Welcome! By signing up with Candoo’s Online Auction Services, you agree to the following terms and conditions. These terms may be updated from time to time, so we advise you to check back to ensure that changes do not impact you.
To activate your service you will need to supply your full name, physical address and any other required fields.
You are responsible for keeping your password secure. Candoo does not have access to your password. All passwords are encrypted.
Eligibility for Membership: Our services are available only to individuals who can form legally binding contracts under applicable law. You will maintain that you are 18 years of age or older and have full legal capacity to complete a contractual agreement. If you do not qualify, please do not use our services.
CREDIT CARD: A valid credit card may be required to be on file before placing bids. If you are the successful bidder and the auctioneer doesn't receive payment by the required time frame your credit card will be charged to pay for the invoice whether you pick up your purchase or abandon it.
Fees: Registering for Candoo’s online auction services are free. There will be a 15% buyer’s premium added to the final bid price for all winners.
Warranties and Guarantees: All items are sold "AS IS," with no warranty expressed or implied by Candoo or its suppliers. Our company and our suppliers specifically disclaim the implied warranties of title, merchantability, non-infringement, and fitness for a particular purpose. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights-and you may also have other legal rights, which vary, from state to state.
Bidding and Buying: As a bidder if you have the highest bid at the end of an auction at or above the opening bid price (or in case of reserve auctions, at or above the reserve price), you are obligated to complete the transaction. Bids are non-retractable except in exceptional circumstances, such as changes being made to the description after you bid or clears typographical errors. You may not bid in a way that pulls other bidders to their maximum bid, retract the high bid, and then rebid at a small increment above the legitimate high bidder. Placing a bid constitutes a binding offer between you, the Bidder, and the Owner/Seller. You are placing your bid based on your interpretation of the item(s) value. You are contractually obligated to buy the merchandise at the price stated as Your bid, as well as pay all other applicable taxes, fees, and 15% Buyer’s Premium.
Before placing a bid, please make sure you are available during the posted pick-up times for the items you have won. If you are unable to personally pick up the items at that time someone else may pick them up on your behalf. You will be responsible for being prepared with all the necessities that will require you to pick up your item(s) such as packing materials and adequate help. In some instances there may be an alternate pickup time for an auction with a $95 alternate pickup fee but this is on a case by case basis. In the event that your item(s) are not picked up in the allotted pickup window your items will then be forfeited back to the seller to do with as they wish.
Buy It Now: Occasionally there will be a buy it now option. This the easiest way to make a purchase on an item.
PLEASE NOTE: All Credit Cards will be charged at the close of the auction. An email and invoice will be sent at the closing of each auction with a detailed summary of your winnings and a balance reflecting zero. If you are the successful bidder and the auctioneer doesn't receive payment due to a card being declined you will be notified immediately and have until 9am the following morning to rectify the invalid card. Failure to do so will result in having all bidding rights blocked.
No Price Manipulation: Sellers may not manipulate the price of their item(s) either by using a secondary or third party, or by bidding themselves.
Personal Information: The information you provide to Candoo is for our use only. We do not sell any information to mailing lists or any outside sources.
System Integrity: You may not use any device, software, or routine to interfere or attempt to interfere with the proper working of the Candoo site or any auction being conducted on our site. You may not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You may not disclose your password to any third parties or use your password for any unauthorized purpose.
Breach. We may issue a warning, temporarily suspend, indefinitely suspend, or terminate your membership and any of your current auctions immediately if you breach this agreement or if we are unable to verify or authenticate any information you provide to us.
Limit of Liability. Under no circumstances will our company or our suppliers be liable for lost profits or any special, incidental, or consequential damages (however arising, including negligence) arising out of or in connection with this agreement. If seller is unable to produce the item being sold for whatever reason, buyer will be refunded the full amount paid only
General Compliance with Laws. You shall comply with all applicable laws, statutes, ordinances, and regulations regarding your use of our service and your bidding on, consigning, purchasing and selling of items.
Notices. Except as explicitly stated otherwise, any notices will be sent by email to the email address you provided to Candoo during the registration process (in your case), or such other address as the party shall specify. Notice will be 24 hours after email is sent, unless the sending party is notified that the email address is invalid.
General: These Terms and Conditions and their interpretation shall be governed by the laws of the state of Ohio. Auctions with ONLINE ONLY bidding are not subject to the Auction statute (4707) and are not under the supervision of the Department of Agriculture. Any suit relating to these Terms and Conditions shall be brought to the Court of Common Pleas in the county in which the auction is conducted. Any controversy or claim arising from or relating to these Terms and Conditions, or breach thereof, shall be settled through the America Arbitration Association or any substantially similar association in the appropriate jurisdiction, and judgement on the decision rendered by the arbitrator, may be entered in any court having jurisdiction therefore. In any litigation, arbitration, or other legal proceeding which may arise between any of the parties hereto, the prevailing party shall be entitled to recover its costs and expenses, including costs and expenses of arbitration, court costs, and expenses incurred on appeal, and reasonable attorneys’ fees incurred in any dispute through arbitration and appeal of and final judgement in addition to any relief to which such party may be entitled.
Candoo may collect personal information such as your name, address, or credit card details. This information is only used to render our services to you and will not be shared with others unless it is required to render this service. An example of such is to share information with a third party vendor such as the payment gateway.
We may have to disclose personal information should this be required by a court order.
Sensitive information is stored in an encrypted format, and although we do everything to keep this information secure, we cannot guarantee absolute security.
